We have received several notices from our carriers that there have been numerous 3rd party websites that market Medicare Advantage and Prescription Drug Plans in violation of CMS’ Medicare managed care
Third-party websites that market MA and Part D sponsors’ products are expected to meet applicable CMS marketing requirements. In order to maintain compliance with these requirements, please review the below and ensure your website does not participate in any of the following:
- Inappropriate requests for health status information such as pre-existing conditions, weight, and whether the beneficiary smokes
- Misleading information, such as identifying a Medicare Supplement plan as a Medicare Advantage plan
- Use of prohibited terminology, including unsubstantiated absolute superlatives (best, most, etc.)
- Absence of required disclaimers
